How is compensation provided to victims in emergency situations, and is housing provided to affected people if their home has been damaged as a result of an emergency?

According to the resolution of the Government of the Republic of Kazakhstan dated December 19, 2014 No. 1358, compensation for damage (damage) caused to victims as a result of natural emergencies is carried out at the expense of the budget funds of the local executive body provided for the elimination of the consequences of natural emergencies, voluntary contributions from citizens, foundations and public associations, and other sources.

At the same time, the victims who have suffered material damage, within thirty calendar days from the date of occurrence of the emergency, submit to the local executive body an application for compensation for material damage.

The application for compensation for the damage caused is accompanied by:

1) a copy of the identity document of the injured person;

2) a list of the lost and / or damaged property of the victim from the moment of occurrence of a natural emergency or during the liquidation of an emergency.

The application for compensation of material damage is considered by a specially created commission of the akimat within fifteen working days from the date of receipt of the documents.

Compensation for damage (damage) caused to individuals and legal entities by man-made emergencies is made by the causer of the damage (damage) voluntarily or by a court decision.

Non-refundable:

1) temporary structures, household and other buildings that are not related to real estate objects in accordance with the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities, as well as illegally constructed objects;

2) valuable clothing, luxury items, or items made of precious metals, items of artistic value.

To provide housing, in accordance with the Decree of the Government of the Republic of Kazakhstan dated November 21, 2021 No. 1222 "On Approval of the Rules for providing Housing to Citizens left without housing as a result of an Emergency", it is necessary to apply to the local executive body with the following documents in accordance with the established procedure:

1) a copy of the identity document of a citizen of the Republic of Kazakhstan. In case of loss or destruction of such a document, as a result of an emergency or during its liquidation-a copy of the temporary identity card issued by the internal affairs bodies;

1-1) an application from the owner of the immovable property (or from his representative by proxy) in the prescribed form;

2) technical passport of the real estate object (housing);

3) identification document for the land plot (act on the right of private ownership of the land plot);

4) a certificate of the absence (presence) of real estate issued by the State Corporation "Government for Citizens".
