Paris court decided in favor of the Republic of Kazakhstan on the claim of the company "Tasyapi Insaat Taahhut San. ve Ticaret A.S."

On October 12, 2021 the Paris court ruled in favor of Kazakhstan on the claim of the company "Tasyapi Insaat Taahhut San. ve Ticaret A.S.". The Claimant demanded the court to cancel the earlier arbitration decision, according to which Tasyapi is obliged to pay 6.7 billion tenge to Kazakhstan.

The Republic of Kazakhstan convinced the Court that the claim is unlawful and decided that Kazakhstan was entitled to be paid by Tasyapi EUR 30 000 as legal fees.

The subject of the proceedings in France was an arbitration dispute between the Committee of Roads and Tasyapi, in which the CoR was accused of illegally terminating the contract for the construction and reconstruction of the
“Aktobe-Makat” road. The amount of the claims was 6.5 million USD. On December3, 2019, the Tribunal of the Singapore International Arbitration Centre rendered an award in favor of the Republic of Kazakhstan and satisfied the Kazakhstan’s counterclaims. The place of arbitration was Paris.

Representation and protection of the State interests in this case is provided by the Ministry of Justice of the Republic of Kazakhstan. The law firm “Curtis, Mallet-Prevost, Colt & Mosle LLP” was involved as a consultant.
